Korean Yearbook of International Law (Vol. 5)

1964년에 설립된 사단법인 세계국제법협회 한국본부(Korean Branch of the International Law Association, 회장 성재호 성균관대학교 법학전문대학원 교수)는 2018년 12월 「Korean Yearbook of International Law」(한국국제법연감, KYIL) 제5호(vol. 5)를 발간했다.

한국국제법연감은 국제법과 관련된 우리나라의 실행을 정리하고 외교적 쟁점에 대한 해석과 이론적 논의를 담고 있는 점에서, 학술적 논의를 중심으로 하는 기존의 저널과는 정체성과 기능 면에서 성격을 크게 달리한다.
한국국제법연감 제5호는 한반도 평화와 번영이라는 큰 주제 아래 대한민국의 현안문제와 관련된 국제법적 이슈에 대한 국제사회의 이해를 제고하기 위해 ‘EEZ의 법적 지위와 독도 인근 지역의 경계획정의 함의’ 및 ‘일본의 독도 영유권 주장과 식민지 책임에 관한 국제법적 검토’, ‘이주노동자의 보호와 이주노동자권리보호협약에의 가입’, ‘북한의 중대한 인권침해행위에 대한 대응’과 관련된 국제법적 주제들을 우선적으로 구성했다.

ILA 한국본부는 앞으로도 한국국제법연감을 통해 국제현안에서 우리나라의 국제법 실행 및 외교정책에 대한 국제법적 정당성과 합법성을 대내외적으로 전파함과 동시에, 국가정책에 대한 건전한 감시자의 역할을 수행함으로써 대한민국의 국익증진에 기여한다는 사명감을 가지고 적극 노력할 것이다.

세계국제법협회 한국본부

‘세계국제법협회(International Law Association: ILA)’는 1873년 10월 브뤼셀에서 설립되었다. ILA는 “국제공법과 국제사법의 연구, 명료화 및 발전을 도모하고, 국제사회에서 국제법에 대한 이해와 존중을 더 확장해 나가는 것”을 목적으로 한다. ILA는 국제연합 내의 다른 다수의 특별 기관들과 함께 국제적 비정부기구(NGO)로 자문기구로서 역할(Consultative Statue)을 하고 있다. 본부는 런던에 있으며, 2016년 현재 전 세계 약 3,500명이 회원으로 소속되어 있다. 다수의 ‘국제분과위원회’ 체제로 운영되고 있는 ILA는 2년에 한 번 정기총회를 개최하고 있는데, 제78차 총회가 2018년 오스트레일리아 시드니에서 개최되었으며, 제79차 총회가 2020년 일본 도쿄에서 개최될 예정이다.
ILA는 그동안 ‘해상운송에 관한 헤이그 규칙’, ‘국제상사중재의 규칙’, ‘제한적 무역관행에 관련된 국가의 관할문제에 관한 규칙’, ‘국가면제에 관한 조약을 위한 초안’, ‘문화유산 보호에 관한 협약 초안’, ‘지속가능한 개발에 관한 국제법 원칙의 대한 New Delhi 선언’ 등을 채택함으로써 국제규범의 형성과 발전 과정에 상당한 영향을 미치고 있는 중요한 민간학술단체로 자리 잡고 있다.
