인권법 개론서,
최근의 변화를 반영해 출간하는 ‘제3개정판’
인권법은 ‘인간으로서의 존엄과 가치 그리고 자유와 권리’에 입각하여 법제도와 법현실을 분석·비판하고 그 증진을 위한 대안을 제시하는 법학의 한 영역이다. 나아가 인권법은 인권의 보편적 성격으로 말미암아 다른 국내법보다 국제법(국제인권법)과의 관계에서 훨씬 일원적인 접근방법을 취하는 법률체계이다. 즉, 인권의 보편성 원칙에 따라 국제사회에서 널리 인정되는 인권의 원칙은 바로 우리 국내의 인권원칙으로 인정될 필요가 있으므로 인권법의 체계는 국제인권법과의 밀접한 관련 속에서 살펴보아야 한다.
이에 이 책은 2008년 초판 출간 이래로 국제인권법적 시각에서 변화하는 국내의 인권현실을 반영하여 내용을 지속적으로 보완해 왔다. 이번에 출간하는 제3개정판은 인권 영역에서 최근 쟁점이 되고 있는 부분을 전면 보강하고, 제2개정판 출간 시기인 2015년 이후의 달라진 부분을 수정하는 데 주력했다. 양심적 병역거부자에 대한 사법기관의 태도 변화가 있었던 데 주목하여 이 부분을 보완했고, 설립한 지 20년이 지난 우리나라 국가인권위원회의 기능과 현주소를 집중적으로 짚어보았다. 동물에 대한 인간의 태도 혹은 인권의 연장이라는 측면에서 동물권에 관한 내용도 일부 보완했다.
